Brooklyn Center requires the licensing of on-sale intoxicating liquor establishments (club, wine, intoxicating, brewer taproom, brew pub, microdistillery cocktail room) and off-sale intoxicating liquor (brew pub, smaller brewer, and microdistillery) as defined in Chapter 11 of its City Code.  The license period is the calendar year January 1 through December 31.

Hours and Days of Sale for On-Sale Licenses
No sale of intoxicating liquor for consumption on the licensed premises may be made between 1:00 am and 8:00 am on the days of Monday through Saturday (Minnesota Statute 340A.504). 

A restaurant, club, hotel, brewer taproom, brew pub, or microdistillery cocktail room which holds an on-sale intoxicating liquor license may sell intoxicating liquor for consumption on the premises in conjunction with the sale of food between the hours of 8:00 am on Sundays and 1:00 am on Mondays.  An establishment serving intoxicating liquor on Sundays must obtain a Sunday On-Sale Liquor License (Minnesota Statute 340A.504). 

Hours and Days of Sale for Off-Sale Licenses
No sale of intoxicating liquor may be made by an off-sale licensee (brew pub, small brewer, or microdistillery) except during the legal hours for off-sale at the City's Liquor Stores.



Types of Intoxicating Liquor Licenses

On-Sale Club licenses may be issued only with the approval of the Commissioner of Public Safety, and shall only be granted to clubs, which means an incorporated organization organized under the laws of Minnesota for civic, fraternal, social, or business purposes, for intellectual improvement, or for the promotion of sports, or a congressionally chartered veterans’ organization, which: (1) has more than 30 members; (2) has owned or rented a building or space in a building for more than one year that is suitable and adequate for the accommodation of its members; and (3) is directed by a board of directors, executive committee, or other similar body chose by the members at a meeting held for that purpose.  No member, officer, agent, or employee shall receive any profit from the distribution or sale of beverages to the members of the club, or their guests, beyond a reasonable salary or wages fixed and voted each year by the governing body.  A club must be in existence for at least three years.

On-Sale Wine
On-Sale Wine licenses may be issued only with the approval of the Commissioner of Public Safety.  This license may be issued only to a Restaurant that has a dining area that is open to the general public and has seating for not less than 25 guests at one time.  The Restaurant’s business must be conducted in such a manner that a significant part of the revenue for a license year is the sale of food.  Only the sale of wine not exceeding 14 percent alcohol by volume for consumption on the licensed Premises in conjunction with the sale of food shall be permitted.  The number of on-sale wine licenses shall be unlimited.

On-Sale Intoxicating (Restaurants and Hotels)
On-Sale Intoxicating Liquor licenses shall be issued only to a Restaurant or Hotel; a Restaurant must be open to the general public, with seating for not less than 30 guests at one time; a Hotel must have a dining room that is an integral part thereof, is under the same management and control as the Hotel, with appropriate facilities for seating not less than 30 guests at one time, and where the general public is, in consideration of payment therefor, served with meals at tables.  The number of on-sale liquor licenses issued by the City of Brooklyn Center shall be limited to 18.

Brew Pub
Brew Pub license may be issued to a Brew Pub that operates a Restaurant in the place of manufacture of malt liquor.

Brewer Taproom
Brewer Taproom license is available only to the holder of a Brewer’s license.

Microdistillery Cocktail Room
Microdistillery Cocktail Room license may be issued to the holder of an Off-Sale Microdistillery license.

Sunday On-Sale Liquor
This license may only be issued to establishments that hold an:
  1. On-Sale Intoxicating Liquor License and that serves Liquor only in conjunction with the service of food;
  2. On-Sale Brewer Taproom License;
  3. On-Sale Brew Pub License and that serves Liquor only in conjunction with the service of food;
  4. Off-Sale Brew Pub License;
  5. Off-Sale Small Brewer License;
  6. Off-Sale Microdistillery License, but only if the City’s municipal liquor stores are open on Sunday, and then only during the same hours; or
  7. On-Sale Microdistillery Cocktail Room License.

An establishment that obtains a Sunday Sales License for Sunday sales under one license is not required to obtain a Sunday Sales License for any other license the establishment holds that allows sales on Sundays for the same Premises.

Payment must be made in cash, cashier's check, or certified check payable to City of Brooklyn Center.
Club, Wine, and Intoxicating license fees for a new license are pro-rated on a daily basis from the City Council approval date.  Sunday license fees are pro-rated on a monthly basis from the City Council approval date.
